Sir if employer suddenly terminate an employee they should pay the due same day pleaae advise

A.Dear client,
he must serve notice before terminating you. You have all the rights, issue a legal notice to the employer i.e, Reporting Manager, HR Department and Review officer. Subsequently, if no use or reply from the employer, you can file a complaint before the local Labour Commissioner. In case of any other clarification please feel free to contact.

A.Dear Client,
First of all an employer cannot terminate an employee without a notice or pay in lieu of notice even in case of any disciplinary action when taken against a proven misconduct. On the other hand, termination for unsatisfactory performance may qualify as retrenchment – i.e., the termination of an employee/ worker for any reason other than by way of disciplinary action, then they are to be given at least 1-month prior notice and payment in lieu of notice of termination in compliance with the Sec.25N(1)(a) of Industrial Dispute Act, 1947 provided the employee is a workman as defined under Sec.2(s) of the Act. Or else an employee belongs to the manager/supervisory category, then he has to pursue a civil suit before a Civil Court for redressal of his grievance. Reach out to an Advocate for serving legal notice to the Company for unethical and unfair labour practices and for further guidance and steps in the matter.
