Finance company seized my bike on 1 Nov 21 from my home. i have checked on m-parivahan that bike have challan in Feb -23 on my name. What i can do for this.

A.Dear Client,
When Finance Co seized your vehicle on 01/11/2021, they must have issued a seizure list/certificate to you. Finance Co. sold out the said seized vehicle through auction to recover the dues lying outstanding against the borrower. The purchaser who bought the vehicle through auction did not transfer the ownership of the vehicle in his name in the Certificate of Registration(RC) so far, and as a result, when the vehicle violates any traffic rules in the month of Feb, 2023, a Challan is generated by the Motor Vehicle Deptt. against the name of the earlier owner as appears in the RC of the vehicle. As per Motor Vehicles Act, 1988, the sale of a vehicle requires to be transferred in the name of the new owner within 30 days after the date of sale. So in the prevailing situation, you need to inform the matter to Finance Co referring seizure list who sold the vehicle on auction to take necessary action and visit the office of the Motor Vehicle Department to file an application to the concerned RTO explaining therein the entire fact behind your concern attaching therewith a copy of seizure list/certificate of the Financer for taking n/a in the matter. Once you brought the matter to the notice of the Motor Vehicle Deptt. you may relieve yourself from all sorts of obligations and unwanted consequences arising out of said vehicle. You must take a receipt of your application to M V Deptt. for future reference and send a copy of said receipted application to the Finance Company by registered post for their information and n/a.
