If an office bearers of "Residents Associations" have committed fraud then what are all remedies available? I mean, which all authorities the Complaint/Suit can be filed?

A.Dear Client,
If an allegation of fraud or misappropriation of funds is raised or brought against an office bearer of RWA, following the provision of Byelaws disciplinary action shall be initiated against the errant office bearer, and after exhausting the actions recommended under Byelaws, if the matter is not resolved then the matter may be reported to the Registering Authority along with the findings of the disciplinary committee of RWA and after hearing the parties by the Registering Authority, if the matter is not resolved on the ground of complex question of law and facts that requires adjudication by a competent Court of law then, a Civil suit may be filed by the RWA against the errant office bearer in the Civil Court claiming recovery of money, damages caused to RWA for the fraudulent act of the office bearer. After going through the merit in pleading, supporting documents/evidence, and hearing the parties if the Court finds him guilty of the charge, then the court may pass an order accordingly or may pass an order acquitting him from the charge/allegation. RWA needs to hire an Advocate to represent the matter before the Court.
