Our association is not renewed its registration for several years and they are collecting maintenance charge every month and not giving receipts. From last month onwards they increased the maintenance charge, when I questioned about the increase and non renewal of registration the office bearer was not giving any reply in this regard. Kindly advise me how to go about.

You cannot fight single handedly. If you are supported by other residence of your Association then you may go and file complaint with Registration Authority who will issue a notice and why accounts of the Association were not audited etc.

A.Dear Client,
A Certificate of Registration once granted to a Housing Society or Association under the State-specific Act does not require renewal and it remains valid until it is dissolved either by a resolution of governing body or by the order of Court. A Society or Association is governed by its Byelaws that provides election of members of Governing Body generally on the gap of every three years through the process of election following the provision of Byelaws of the Society or Association. A statutory report of new elected members of the Society or Association is sent to the Competent Authority in compliance with the provision of relevant Act. A resolution enhancing the maintenance charges is taken on majority of votes in a Meeting following the provision of Byelaws and such a resolution is equally applicable to all the members of the Society or Association. If such enhancement appears unfair or exorbitant, you may take up the matter individually or collectively with the GB of the Society failing which you may escalate your grievance before the Registering Authority/Competent Authority for a resolution in the matter.
