I would like to know about Article 26 law for professionally and education.
A.Dear Client,
Article 26 of the Indian Constitution states that every religious denomination or any section thereof shall have the right to establish and maintain institutions for religious and charitable purposes. This includes the right to manage their own religious affairs, establish and maintain religious institutions, and provide religious instruction.
The scope of Article 26 extends to the regulation of educational institutions run by religious denominations. Religious institutions generally have the freedom to establish and manage educational institutions that promote and impart religious teachings and values. However, these institutions are also subject to reasonable regulations imposed by the state in order to maintain standards of education and prevent any form of exploitation or discrimination.
It is important to note that while Article 26 guarantees certain rights and freedoms, these rights are subject to reasonable restrictions imposed by the state in the interest of public order, morality, or health. Article 26 of the Universal Declaration of Human Rights (UDHR) makes universal free primary education compulsory and is usually thought of as a right about children. Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit. Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance, and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace. Parents have a prior right to choose the kind of education that shall be given to their children. As per the Right to Education Act and Article 21 A of the Indian constitution, Education up to 14 years is a fundamental right and it should be free and compulsory.
