Remedies available to the assessee where
The Income Tax Appellate Tribunal passes order allowing the appeal in favour of the assessee and gives directions to the Assessing Officer implementation of which will result in payment of refund and interest to the assesse
The Assessing Officer does not give Appeal Effect and does not do anything to implement the Order of the Income Tax Appellate Tribunal even after the time limit specified in Section 153 is over.

A.Dear client,
In any event, in accordance with the mandate of law, the appeal effect order has to be passed within three months of passing of the appeal order. In view of the above HC directs that necessary appeal effect orders and payments of refunds shall be made within the said period of six weeks.
