one person beaten up his 82 years old father. father has lodged complaint in concerned police station. police lodged FIR but no punitive action was taken against the accused. after some time accused lodged a false complaint against his father and younger son and taken his father's 100 sq.meter plot forcibly by threatening the family. i want to refer this complaint on behalf of deceased father to Senior Citizen Commission
please help me in this regard..

It seems the victim father is no more as such the senior citizen commission may refer the matter to police station to registered FIR and to arrest the culprit.

A.Dear Client,
Under the Maintenance and Welfare of Parents and Sr. Citizens Act, 2007, only Sr. Citizens are allowed to file complaints against the errant children or relatives before the Maintenance Tribunal presided by the SDM of the respective sub-division or the DM of the respective District. This benevolent act is exclusively enacted for the protection of the safety and security of Sr. Citizens who are being harassed and abused by their children/family members. No Advocate is allowed in the proceedings to represent the case either on behalf of Sr. Citizens or OP, erring children/relatives and almost hassle-free, less costly, and easy to access Justice. In the absence of your father(who expired by the time), your aged mother can make an application before the Maintenance Tribunal against the errant son praying for appropriate relief. The maintenance Tribunal is empowered to pass an order of maintenance for a sum up to Rs.10,000/-pm including an order of eviction of erring children/relatives from the property belonging to Sr. Citizens/Parents which is unauthorisedly or forcibly occupied by an errant son. You can seek the assistance of any social organization or NGO to escalate the grievance before the Authority.
