A.Dear C;ient,
It appears that due to a lack of proper searching/verification of the status of the title and encumbrance of the property before executing the sale agreement and payment of earnest money to the seller, you are now facing such an ordeal. So, in the prevailing situation, serving a legal notice to the concerned party, file a criminal suit against the concerned person/s for cheating under Sec.415 of IPC before the competent Court having jurisdiction over the suit property. Additionally, you need to file a money suit against the concerned party/s before the Civil Court for recovery of money remitted against the purported sale agreement. Reach out to an Advocate for further guidance and steps.

A.Dear Client,

Examine the terms of the sale agreement to determine if there are any clauses or conditions that might provide you with protection or legal recourse in case the transaction is illegal. If the sale agreement clearly shows that the transaction is illegal or cannot be registered due to the land being owned by a minor, you may attempt to negotiate with the seller for a refund of your payment. Document all communication related to this negotiation. If negotiations fail and the seller refuses to refund your payment, you can consider filing a formal complaint with the local police or appropriate authorities against the seller for fraudulent or illegal activities. If necessary, you may need to take legal action against the seller in the civil court. Consult with a lawyer to initiate legal proceedings to recover your money. You may also want to report the illegal sale to the local land revenue authorities or other relevant government agencies.
