Encroachment on canal

My neighbour has constructed a house on canal and not leaved an Inch of setback. There is a public pathway adjacent to th canal. During winters tth snowy of The rooftop of the said house directly falls on that pathway. Now I request you to please guide us what to do in accordance to law.
