A.Dear Client,
In the prevailing situation, you can file a complaint under Sec.35 of the Consumer Protection Act, 2019 against the online coaching institute UPSC PATHSHALA for deficiency in service and unfair trade practice claiming a refund of the entire coaching fees along with compensation for harassment. Since the institute is providing online service, the complaint needs to be filed online mode through e-daakhil portal ( https://edaakhil.nic.in/edaakhil/ ) following the provision of Consumer Protection (E-Commerce) Rules and Consumer Protection(Direct Selling) Rules, 2021. Since a Complaint under the Act is required be filed within two years from the date of cause of action, so, it is time-barred under Sec.69 of the Act. Accordingly, you have to file an additional petition praying for condonation of delay along with the original complaint petition enclosing therewith sufficient proofs that support your prayer for condonation of delay. Otherwise, your complaint may be dismissed by the Consumer Commission being barred by time. If the coaching institute kept any franchise office in your district, then you can file an offline complaint before the Dist. Consumer Commission to handle the case physically through an Advocate. Reach out to an Advocate for guidance and steps.

A.Dear Client,
Firstly, keep records of all communication, including emails and call records, with UPSC PATHSHALA regarding the issue. This documentation will be important if you decide to pursue legal action. India has consumer protection laws in place to safeguard the rights of consumers. The Consumer Protection Act, 2019, allows consumers to file complaints against unfair trade practices and deficient services. You may consider filing a complaint with the appropriate consumer forum.
