I am an Bank employee of an Loan Division _ when processing Balance Transfer of Agri loan there was a lapse in Balance Transfer procedures by the sales team employees ( there is NO Intentional employees) it was an error.

This process lapse were taken as advantage by client and he enjoying the bank funds and not repaying to Bank .

What will be the employees position in this case _ If at all Bank wants to take action on employees _ Though it was not a intentional mistake or Fraud _ But it is a process lapse .

A.Dear Client

For sure the bank is goin to take disciplinary action against the employee for the lapse, regardless of being intentional or not.
Simultaneously the bank should send legal notice to the borrower to repay the amount and take legal action too.

A.Dear Client,
Dereliction or negligence to discharge assignments even if it is caused unintentionally without any ulterior motives or for technical hazards or failure on the part of other employees is considered misconduct on the part of employees involved in the matter and if the charge is proved in the departmental inquiry carried on by the vigilance deptt. of the Bank, you along with others, if involved, may face show cause/chargesheet and disciplinary action as per the standing service rules of the concerned Bank. You can't escape from the contractual obligation/liability taking the plea of innocence and unintentional human error if you fail to prove your stand before the inquiry committee. So, gather all the relevant evidence/ documents that may support your stand of process lapse or human error and defend your case suitably before the inquiry committee to make yourself free of charge. You can take the help of your colleague who is aware of the facts and well conversant with the service rules of the Bank and apply to the Bank to allow your colleague to accompany you as an observer during the inquiry proceedings which may be allowed by the Bank following the principle of natural justice.
