Placement of generator

Generator is located under my balcony. When it runs exhaust fumes get into my apartment causing uneasiness. Requested builder to move it, but he ignored. Other members of the building refuse to cooperate or move it. What to do. Don’t want to go to court as it will cost and drag for long. We are past 85.
