I need legal advice against mental torture by my husband.
Hello,
I am a 34-year-old married woman with a 1-year-old baby. I need a legal consultation from a lawyer who help me file a case for mental harassment against my husband and his family.
My husband has been mentally harassing me for ten years over being dependent on him for everything and poking me to the point where I lose my temper and harm myself. He has been using words which constantly demean my identity, and due to that torture, I always felt to commit suicide. He doesn’t even care about his 1-year-old son. He has thrown me out of the house with the baby. He has been cheating on me for the past few years.
Please help me. I am not strong financially. My husband will go to any extent to prove me mentally unstable so that he can have our son’s custody. I have more than enough evidence, but I have no legal connections. Please help me
I am really sorry to hear that you have to go through all these.
You need to immediately contact a divorce lawyer, who would file and lodge the cases against your husband.
You have a lot of options available-
You can lodge a complain under Section 498A.
You can file a divorce, a Maintainence case etc.
Please don't take this lightly and take immediate actions. Accused person must get his punishment.
First collect all the required documents and accumulate some amount for your future livelihood thereafter start fighting with your husband and his parents, legally.
This issue comes under domestic voilance act. You can seek for legal remedy under IPC section 498A cruelty. This is about the criminal remedy. You can even go for civil remedy under Civil Remedies: Protection Of Women Against Domestic Violence Act, 2005.
You can even reach out to court their are family courts set up for this kind of issues to deal with.
Thankyou
In the given situation, if you possess strong evidence of mental cruelty and harassment you faced at your matrimonial home from your husband and in-laws, you can lodge an FIR with the concerned Police Station having jurisdiction over your matrimonial home, the place where you are staying (if not staying in matrimonial home) or, where the incident of harassment/violence took place u/s.498A of IPC against your husband and other family members of your in-laws' house who are involved in the criminal act and simultaneously file a complaint under Sec.4 of the PWDV Act, 2005 before the Protection Officer or the Magistrate. Upon receipt of a complaint of domestic violence, the Protection Officer or the Service Provider has to prepare a DIR in Form 1( as provided in the Domestic Violence Act) and submit the same to the Magistrate and copies of the same to the police officer in charge of the concerned police station. Considering the complexity involved in Domestic Violence cases, it is advisable to hire an expert Advocate to access justice and appropriate relief in the matter. If you are not financially sound enough to continue with expenses involved in litigation, you can make an application before the Member Secretary, State Legal Services Authority or Dist. Legal Services Authority seeking free legal services available to women under Sec.12(c) of the Legal Services Authority Act, 1987
