I am working in education department as jr. Supdt. I was suspended based on vigilance report which had no concrete findings by the govt. Solely because i had helped a opposition member in elections. Now my promotion is due this February and whether if i am not included in select list of sr. Supdt based on dpc is there any remedy

A.Dear Sir,
It is a service matter. You must work out for revocation of your suspension first then think of promotion otherwise there are chances of termination in these competitive and jealous days.

A.Dear Client,
Interview, selection, appointment, promotion etc all these activities were carried on by respective establishments as per the well-established recruitment policy made out considering a variety of factors and following the principle of natural justice. Promotion to a higher grade or position cannot be claimed as a matter of right. Above all, it is the prerogative of the selection committee to decide who is to be selected for a vacancy or not following the well-established recruitment policy. Only in case of deviation/discrimination/mala fide in the selection process, if appears on the face of the record, the Administrative Tribunal/High Court may entertain an appeal challenging the selection process violating the well-established recruitment or promotion policy. Otherwise, an appeal may be rejected at the stage of admission. Suspension from service for proven misconduct is a stigma in the service record of an employee which may be a cause of non-selection for your promotion to higher grade. If such stigma is condoned by the DPC, then you can expect your selection for promotion to the next higher grade.
