I want to open a dental clinic for my wife.
We are located in Ghaziabad and I want to use my residence home area for the clinic.
So i want to know what all documents and permissions will be required? Is it legal to open?
and I dont want to convert electricity and water to commercial.is its fine?

A.Dear Sir,
It depends upon mentality of the neighbors. If any objections are filed then they would be some problem. If you are owning independent house you can start it in the name of your wife but not if you owning a flat in the apartments.

A.Dear Client,
Since the Dental Clinic involves various "surgical /intervention procedures" (and not only the consulting office), permission for the same would not be possible in residential premises, even with a "trade license" which is usually issued by the Civic Corporation. Only "Consulting office" is permitted to be conducted by Professionals (Doctors, Lawyers, ... ) from Residential premises. A dental clinic which is a commercial activity can be started in a Shop /Office (commercial premises). The various permissions and requirements needed to open a dental clinic in India that include - Registration of the clinic –and a license from the state-level professional medical establishment authority, under the Clinical Establishment Act.
Registration with State Dental Council, AERB clearance-atomic energy research board---Radiation safety, Biomedical waste management from pollution control board, Register the clinic with PAN card for TDS, service tax, GST etc. Apart from this, there should be statutory compliance with the following: Dentist Act 1948, Pharmacy Act, 1948, Narcotic Drugs and Psychotropic Substances Act, 1985, Environmental Protection Act, 1986, Water Pollution Act 1974, Air Pollution act-1982, Drugs and Magic Remedies (Objectionable Advertisement) Act, 1954, Persons with Disabilities (Equal Opportunities and Full Participation) Act, 1995, Bio-Medical Waste (Management and Handling) Rules, 1998, Epidemic Disease act-1925, Poisons act-1919 Drugs and Cosmetics Act, 1940, Clinical Establishment act 2010.
