A.Dear Client,
In a situation where an amount of Rs. 50,000 was held by the Vice Secretary of the housing society due to medical emergencies, and after 10 years, the new committee holders are seeking repayment, several considerations come into play. First, it's essential to review the records and documentation from that period to establish the legitimacy of the amount and its purpose. If you have evidence that the funds were acknowledged and shown to society members during the transition, it can strengthen your position.
However, if the person who had the money has sold his flat, recovering the amount directly from him might be challenging. In such cases, the housing society may need to explore legal options against the former Vice Secretary, considering the evidence and circumstances. Consultation with a legal professional can guide you on potential courses of action, which may involve sending legal notices or initiating legal proceedings.
Sections related to recovery of amounts or disputes under cooperative housing society laws, as applicable in your state, may be relevant. Seeking advice from a lawyer with expertise in cooperative housing society matters can provide a more precise understanding of the legal recourse available to your housing society in this specific situation.
Thankyou
