A.Dear Client,

The Maharashtra Agricultural Lands (Ceiling and Holdings) Act, 1961 imposes limits on the amount of agricultural land an individual or family can own. Excess land is taken over by the government and distributed to landless farmers. Under Section 43 of the Bombay Tenancy and Agricultural Lands Act, 1948, when selling agricultural land, the seller must submit a copy of the Sale Permission obtained from the Sub-Divisional Officer. If Sale Permission is granted for non-agricultural use, no further action is needed. However, if it's granted for agricultural purposes, the seller must apply to the Sub Divisional Officer for a change of use.

The Sub Divisional Officer may permit the change if it aligns with laws, rules, regulations, and policies supporting development control efforts. When a non-agriculturist purchases agricultural land for non-agricultural purposes, both the buyer and seller must jointly apply to the Sub Divisional Officer for the land transfer.

A.Dear Client,
The Maharashtra Agricultural Lands (Ceiling and Holdings) Act, 1961 places a ceiling on the amount of agricultural land that an individual or family can own. Any surplus land is taken over by the government and distributed to landless farmers. As per provisions of Section 43 of the Bombay Tenancy and Agricultural Lands Act, 1948, the Seller of agricultural land has to submit a copy of the Sale Permission received from the Sub-Divisional Officer of his area or a part of the area of land. If the Sale Permission is already granted for the non-agricultural purpose for which he is applying, he need not act further but if the Sale Permission is granted for agricultural purposes, he is required to apply to the Sub Divisional Officer for the change of use. Sub Divisional officer may grant permission for the change of use of land if, the granting non-agricultural permission shall not be contradictory to the laws, rules, regulations, and policies which aided the development control efforts. If the buyer is a non-agriculturist while selling agricultural land for non-agricultural purposes, the buyer and seller both are required to apply to the Sub Divisional Officer for transferring the land.
