Can tenant use open parking of society
I live in Mumbai in a rented flat. I have a proper 3-year agreement with 1 year as Frozen (I cannot leave nor the owner can remove me). I am still in my one year.
There is a big open place in the society compound where people park cars.
I had guests over and they parked 3 cars in the compound.
Then a popatlal/karen of society came and started arguing to only have one car in the parking and keep the other 2 outside on the road.
His argument was I was renting the flat so I had no say in society matters and because he is the owner he can tell me to do anything.
I refused and it got converted into a big fight. Finally, the Societ Secretary allowed me to park in the open place.
My questions are:
1. Do I have legal rights to park my cars/guests' cars without fear of society?
2. What could I have done if the secretary had said no? Are society members allowed to refuse parking to tenants even if it is an open parking?
3. Can I send notice to the guy for harassing me on an important day when I was having a function? If so, will I have to do "Court ke chakkar" because of this? The reason I want to send him a notice is so he will stop harassing me for any future events. The guy has an image of a troublemaker in the society.
As a tenant, your rights in the society are limited compared to the property owners. Rather than resorting to agitation or litigation, which could prolong the resolution for months or years, consider seeking an amicable settlement for the smooth celebration of your family functions.
Being a tenant you have limited rights to exercise in comparison to owner members of the society. So, instead of agitation or litigation that may drag the matter for months/years, try to settle the matter amicably for a smooth celebration of your family functions.
