A.Dear Client,

If you are facing issues with recovery agents appointed by a bank or NBFC, you can take the following steps to address the situation:

1. File a Complaint with Local Police:
- Visit your local police station and file a formal complaint against the recovery agents.
- Endorse a copy of the complaint to the concerned bank or NBFC to keep them informed about the situation.

2. Submit a Complaint to RBI:
- Lodge a complaint against the loan recovery agents through the Reserve Bank of India (RBI) Complaint Management System (CMS) at https://cms.rbi.org.in.
- Alternatively, you can call the helpline number 14440 for assistance.

3. Offline Complaint Submission to RBI:
- If you prefer offline submission, file a written complaint and submit it at the Centralised Receipt and Processing Centre (CRPC) at RBI, 4th Floor, Sector 17, Chandigarh, PIN-160017.

4. Refer to Recent Judicial Decision:
- Refer to the recent judgment by the Hon'ble Patna High Court in the case of Dhananjay Seth v. Union of India, 2023 SCC OnLine Pat 1393, decided on 19-5-2023.
- Note the court's direction to the Superintendent of Police in Bihar to ensure that recovery agents do not take the law into their hands without a court order.

5. Credit Counseling:
- Consider seeking a quick counseling session with a certified credit counselor.
- A credit counselor can help you explore options and guide you in resolving or settling the matter amicably with the lender.

It's important to document all communication and incidents related to the recovery agents. Seeking legal advice may also be beneficial to understand your rights and explore further actions if needed. Always prioritize communication and resolution in a lawful and peaceful manner.
