I contacted a broker and then he showed me a flat. After showing the flat he was not responding to me and was not helping me close the deal, and I tried contacting him for three days but then later I managed to get the owners number and I close the deal by myself now after one month the broker is contacting me and asking for for brokerage he did not even contacted me after showing the flat and he also did not contacting the contacted the owner now I need help in what should I do should I give him the brokerage or not

A.Dear Client,

Following the enactment of the Real Estate (Regulation and Development) Act, 2016, it is mandatory for all real estate agents to register themselves with the Real Estate Regulatory Authority (RERA) under Section 9 of the Act. The functions and activities of real estate agents are regulated by Section 10 of the same Act. If the agent you are dealing with is a registered agent under RERA, you can file a complaint against them for unfair trade practices before the Adjudication Officer at RERA under Section 31 of the Act for resolution.

On the other hand, if the agent is not registered with RERA, you can serve a legal notice to the agent and then lodge a complaint against them with the nearest police station. Additionally, you may file a criminal suit against the agent for criminal intimidation under Section 503 of the Indian Penal Code (IPC). Taking these steps will help you seek legal redress in the matter and ensure that your rights are protected.

A.Dear Sir,
If he is not registered broker as per the rules of RERA you need not oblige him. More so, there seems to be no written agreement between you as such the contract is void.

A.Dear Client,
After the enactment of the Real Estate (Regulation and Development) Act, 2016, all real estate agents are mandatorily required to register themselves with the RERA under Section 9 of the Act and the functions or activities in the real estate business are regulated under Sec.10 of the said Act. If your so-called agent is a registered agent under RERA, then you can lodge a complaint against him for unfair trade practice before the Adjudication Officer, RERA under Section 31 of the Act for a resolution in the matter. Otherwise, serving a legal notice to the agent, you have to lodge a complaint against him with the nearest police station and file a criminal suit against him for criminal intimidation under Sec. 503 of IPC.
