Boundary wall construction

My neighbour has removed the soil to the depth of 4 feet touching my boundary without leaving any distance.Now he is building the wall on the boundary. How much space should he leave from my boundary l8ne to make a wall. If he builds the wall,the rainwater will fall in my territory. Pls give the legal opinion.Thank yoy
