I want to know that under which Section /Provision of CPC/CRPC, Petitioner in-person can file Permission Petition and affidavit to get Certified Copy of NBW Order or any Order passed in CRL-MP (MC) case?

A.Dear Client,

Section 76 of the Evidence Act, 1872 allows parties to obtain certified copies of various documents related to legal proceedings. These documents include judgments, orders, depositions, and memorandums of evidence.

The application for certified copies must be made to the court that has custody of the records, accompanied by the prescribed court fee. The applicant can apply directly or through their recognized agent, pleader, or advocate. The purpose for which the copy is needed must be stated in the application.

If someone who is not a party to the proceeding seeks copies, they must support their application with an affidavit explaining the purpose. The applicant may be required to deposit the estimated costs of the copies, and any deficiencies must be rectified before copying begins.

All certified copies must be dated, subscribed, and sealed as per the requirements of Section 76 of the Evidence Act.

A.Dear Client,
Section 76 of the Evidence Act, 1872 deals with the issue of Certified copies of public documents. Parties to any proceeding may, on application with the prescribed court­fee made to the Court having the custody of the record, obtain certified copies of any judgment, order, deposition, memorandum of evidence, or any other documents filed in the said proceeding. The application may be made by the party himself or by his recognized agent or by his Pleader or Advocate. The application shall state whether the copy applied for is required for private use or otherwise. Applications for copies by parties other than parties to the proceeding shall be supported by an affidavit stating the purpose for which the copies are sought. The applicant shall be called upon to deposit the estimated costs of the copies applied for, and make up other deficiencies then and there only, if his presence is available in the office. In other cases, the orders of the Judge/Presiding Officer shall be obtained requiring the applicant to comply with the requirements before the copying work is taken in hand.. All copies shall be dated, subscribed, and sealed in the manner prescribed by Section 76 of the Evidence Act.
