A.Dear client,
After passing 30 days of non-payment of your salary you can file a case in your Labour Court against your employer according to the Payment and Wages Act.

A.There is nothing called months of pending salary. If your salary is due and is not paid you can file a case in the labour court after passing of 30days

A.There is no question of Pending salary. According to Payment of wages Act 1936, Every Employer is liable to pay salary & wages to every employees before 10th of the succeeding month. You can take up the case with your designated ALC and make a complaint with all relevant documents immediately. If require consult a Labour Court Lawyer to guide & help you quickly.
