New Car damaged by Company New Car damaged by Company

My newly purchased Tata Harrier, which was two months old was having inherent audio issues with the player and shock absorber. I had raised the issue with the company and they got the vehicle collected for repair. While delivering it back to me, their car met with an accident and the vehicle was badly damaged. I do not want to accept the accident vehicle back, I want them to give me a new vehicle. They aren't agreeing to do so. How can I sue Tata Motors?

A.You should follow the following steps

1. Send them a legal notice [demanding replacement of the car and compensation]
2. File a case in the consumer forum and pray for compensation and replacement of the car with a brand new one.
3. Under the said circumstances, it is a clear deficiency of service for which the company should reimburse and compensate you.

You get issue a legal notice and approach Consumer Forum or Insurance Ombudsman as it is insured vehicle.

A.First of all sens them a legal notice immediately and then file a consumer case in the consumer forum for deficiency of services. when you file case demand for replacement of the car and also seek compensation from them.
