Hi Team,

This is my second attempt to write it down. I joined an organisation two months ago. At the time of joining they asked me to give them a suriety cheque of 175000 INR incase if I leave the company before three years.
Now when I want to quit because of the work culture out there, they are ready to go legal and moreover if my chuqe bounces, they can sue me according to the IPC.

Need some advice how should I go on this ?

There is no option to upload the contract. Would have shared it.

The terms used are;
As a part of suriety you are issuing a cheuqe of 175000, in favour of company ABC, Chuqe no. And bank account no. And name of bank. In case there is a breach in agreement between employees, Company can use this cheque as a part of this agreement. What is the benift for employees here I am unable to get ?

Please provide me the Documents Related to your Contract/Agreement.
And, then I'll guide you to take certain steps, so that the Company will not able to place the Security Cheque in there Respective Bank Accounts.

Hi Mam, there are only few clause in the appointment letter. The have always stressed on the contract breach..

Which states that If the employee fails the training or leaves the organisation before the aid of three years, he will pay company 3.5lakhs along with 18% of interest. I am unable to understand how can they be so cruel.

A.Sir,
They can take action U/S 138-OF-NI-Act and this case will be met with acquittal.Reason is "Security Cheque" is not a legally bound debt.Hence you are a lucky person.

Hi Sir,

Even if they have a chuqe and a contract in place. I have resigned earlier and stated that job and work culture is not good. They rejected my resignation.

They never gave me a training and the job they are providing me is also not satsfactory. I will be moving outside India for work and don't want to be in any trouble. Poor people have no rights in the country.

I am already bearing a loan and have no money to pay their debt.
