My own brother wife gone her own house she is not coming back to my brother. This is not first time she is repeating so many time recently we found that shi is having afair .
How can we move ligally ? What can we do know?

Your brother may file divorce case on the ground of adultery and get the same without any alimony.

A.1. Send her a legal notice to come back, failure of which shall lead to filing of RCR
2. File a RCR petition stating that she has left without reasons.

If she does not come back, then the court shall proceed exparte.

A.only her husband can file case on "restitution of conjugal rights ( Request her to come back )" or Divorce. You cannot file. only your brother.
1) Not living with your brother - Duration exceeds 2 years
2) Proof of Affair, if any
3) Reason why she left? any harassment from your Brother
