I have been working in an MNC for the last 4 years with extremely strong credibility. I have been suspended for no valid reasons and still any charges are yet to be framed. In this scenario, do I have any legal recourse if my employer terminates me inspite of being honest and credible?

A.You do not have any remedy against unfair termination. Your remedy against the company depends upon the terms of appointment contract between you and your employer Company. MNC means a private Company and there is no Law which requires a private Company to keep honest workers against the wishes of that Company. It is just like you have a salesman in your shop whom you terminate without any reason, and can you agree if the Law orders you to employ him ? But if there is any benefit your Company has obtained from Government, then you have a chance. Another important matter is that if you have worked in a managerial capacity you will not be a 'workman' and cannot go to Labour Court.

A.First when you say strong credibility what use it in employment. Why you have been suspended pending charges.Secondly all suspensions as a rule can be reinstated with or without enquiry. Thirdly no employer can terminate without valid reasons as per their service rules. Now quickly consult a Labour & Employment and service matter lawyer to guide & help you.It is better to be prepared for any penal action on the part of MNC.We have Various Acts & Law to safeguard the employees,no employer can take illegal recourse be rest assured.
