I was being regularly abused by my colleague, who used cuss and derogatory words. And this happened in front of my other colleagues, who are ready to be witnesses in court.
Additionally, he also harassed me by calling me on phone at 1AM midnight, causing mental trauma to me and my family by waking us from sleep.

I had made a written complaint to the company’s HR a month ago, and no action was taken. I have filed a FIR at the police station.

Want to take this case legal. Please guide.

A.Dear Sir,
If police do not act on your complaint then file a PRIVATE COMPLAINT before Magistrate and also send representation to the Chairman/MD of your company with proofs.

A.In case you are a female and you have been sexually harassed, you can move against that person under Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
In case of non sexual harassment you can move against the person under Labour Laws.

In case you have already filed an FIR, means the legal process is being invoked. Now the police will investigate the matter, record statements, gather evidence etc. Once the police completes the investigation, they file their findings in the chargesheet and if there exists enough proof of the charges made, the case goes to the court.

A.Hello Client,

You can go to Police Station once again and ask to arrest your colleague with charges of harassment.
You can send a legal notice to your company through an Advocate, stating all the difficulties you are facing and also how they have failed to take any action against the same even after complaining, from your end.
