You may get survey the land and in the meanwhile file a suit against them and get a status-quo order against them restraining them from encroaching any portion of your absolute landed property.

A. Hello,
As per the Hindu Seccesion act the property would be divided equally among all the legal heirs, i.e., in your case Son1, Son2, and Father. Son1 and Son2 could get the legal heir certificate and get the property mutated in their name. The Wife2 and Son3 have no right in concerned property and cannot claim the same. After the father's death, his share of property would be transferred to Son1 and Son2.

You can file a partition suit and take all those contentions. Seek relief of partition and such sale deed may be asked to be declared as null and void and not binding upon you since it is a family property in which you have a share.

Time duration for registration after query payment is different in different states in India. But in general and mostly states it is 30 days duration in which you have to register the property and if not able to because of some reason then you'll have to extend these 30 days by informing within the 30 days. If not then they could charge you delay fees in registration.

Property cannot be purchased by paying cash and it will create a problem in future. You may pay all the amounts by way of Bank transfer or through cheque otherwise you will get a problem at future date but there cannot be any problem instantly.
