I made query payment online on 14/04/2021 & got registration of my flat on 24/06/2021 via commissioning at builder's place. After few days someone from registration office called builder/me saying that I will have to pay Rs. 5000 extra due to delay in registration for 2 months or more. I could not find such claim after checking online by the query number, there it's shown as "Number generated & fees is already paid". Could you please tell me is there any timeframe defined for registration any property after making query payment? Whether their claim of Rs. 5000 is valid or not? Please help me on this. Thanks.

A.hello,
Time duration for registration after query payment is different in different states in India. But in general and mostly states it is 30 days duration in which you have to register the property and if not able to because of some reason then you'll have to extend these 30 days by informing within the 30 days. If not then they could charge you delay fees in registration.

The time duration for registration after query payment varies from different state to state in India. To get a better understanding contact the sub registrar office. There you'll able to get all the required information relating to your problem.

A.Dear Sir,
It seems to be a fake call. Ask them to share link so that you can credit the same to the concerned office only. Such fake calls are being used by many brokers etc. Please get issue a legal notice or approach Police.

A.In West Bengal after generating the query, the registration has to be done strictly within 30 days therefrom until and unless through application extension for that validity period has been prayed and granted. If such application for extension of time be prayed within that 30 days period then the validity of the E-assessment query sheet will further be extended automatically. But if such application for extension of time be prayed after expiry of that 30 days period then the Registry Office can impose a charge.

A.See a Sale deed must be presented for registration within 4 months from the date of execution (signing by the parties) or else one has to pay penalty for the same as per Section 23 of the Indian Registration Act of 1908.
And in West Bengal registration process once the query has been raised the query remains valid for 30 days otherwise post 30 days new query must be raised. Since you have already made the payment and got the registration done after 30 days hence they might be asking for extra payment which in my opinion is right.

Section 23 in The Registration Act, 1908
23. Time for presenting documents.—Subject to the provisions contained in sections 24, 25 and 26, no document other than a will shall be accepted for registration unless presented for that purpose to the proper officer within four months from the date of its execution: Provided that a copy a of a decree or order may be presented within four months from the day on which the decree or order was made, or, where it is appealable, within four months from the day on which it becomes final.
