A property should have a clear title, without any dispute. If buying a new property, the title of the land should be with the construction company.
If you are buying an apartment project, make sure you get to see the copy of the approved map from the builder which is passed by the local authority. This is a very important document when buying a resale property to know whether the previous owner had mortgaged the property and if all the dues have been paid.

In case of will, the property will be distributed according to the terms of the will.
If your mother dies intestate, under Hindu law, her children, children of predeceased children and her husband have an equal right to the property. In their absence, the property is inherited by other heirs as per order of preference.

A. Dear Client,
As per the facts stated by you, Your mother is the absolute owner of the property. She has all the rights to transfer the same to anyone, as she desires.
She don't need to register anything to transfer her property to anyone.
If partition deed executed among you 6 members, then all 6 members should sign the same.

A. Hi,
In case of a self-acquired property, the parents can disinherit a child by cutting him out of the will. If a parent dies intestate, the self-acquired property will go to the legal heirs.
