Team, This Matthew belong to state government firm where my father worked.BSEB, Patna.he retd in 2001 and in 2011 while doing the fixation they did some mistakes and they approved a PPO of higher amount and start paying the amount and in 2016 my father passed away and on the basis of that PPO they fixed my mothers pension which was also wrong since the first PPO was wrong ...now they have detected this and rectified the PPO and also reduced the pension and now they are demanding a recovery of 8 years 7 years in my father tenure and 1 year in my mother tenuere... So, my Q is is this type of recovery is acceptable by law?? If not please share some evidence so that I can convince them

You have to approach either Service Tribunal or High Court and get a stay on such illegal demand since it is a mistake committed by them.

Dear sir, I had filed PIL in supreme court to issue writ of mandamus to Election commission of India which was withdrawn by my advocate on the first day of hearing as Hon. Supreme court judge suggested us to make some changes in representation sent to ECI and in this way the PIL was dismissed as withdrawn. The judgement says that-"The learned counsel for the petitioner seeks leave to withdraw this Public Interest Litigation. The Special Leave Petition is, accordingly, dismissed as withdrawn". Please tell me that in this condition, if ECI does not accept my modified representation, Will I be allowed to file PIL again in Supreme Court as I had read somewhere that one can not file PIL on the same subject in Supreme Court again. Please answer my question.

Dear sir, I had recently filed SLP in supreme court against impugned order given by Bombay High Court on my PIL. The PIL was filed to pass order for Election Commission of India to implement the suggestions given by me to ECI. On the day of hearing, Hon. Supreme Court jude told us that your SLP has merits but there are some loopholes in the representation made to Election Commission of India. Hon. SC judge asked us to withraw the SLP and make fresh and modified representation to ECI. Now, my question is that what if ECI does not accept the modified sugestions too. I read that one can not file PIL on the same subject again in supreme court. In my case, can I file PIL in supreme court or any of the high court, if ECI does not accept my sugestions? Please note that the Hon. Supreme Court's judgement only says that, "The learned counsel for the petitioner seeks leave to withdraw this Special Leave Petition. The Special Leave Petition is, accordingly, dismissed as withdrawn". The Hon. judge has not mentioned that he has suggested us to withdraw the SLP. Please answer my question if I can file PIL on this topic in future with modified prayers.

A. Dear Sir,
It is implied that the Hon'ble Supreme Court suggested you to file fresh and modified representation before ECI and confirm the same by way of affidavit and ask the ECI accordingly. If no reply is received or no action is taken against such representation then you can again approach the High Court or Supreme Court raising same issue by way of PIL, which seems to be appropriate step.

Ima Dr appointed through PSC in Kerala. I’m trying a transfer to join spouse in a different district. I’ve received a notice for unauthorised absence after completing maternity leave. I’m told that even though there is vacancy in the district I’m trying to transfer they cannot give me the appointment as an officer after reinstatement has to join a rural area. Is there any such rule? What are my options? Given the present state they’ll post me In a remote rural area in a different district and it’ll be impossible for me to continue.

A. It will be depends on your stats law . In some State having such law after completing MD one year service must in rural area then urban areas please approach to the any local lawyer for it
