A. You should file a PIL as soon as possible. Let this also be clear that if in case you are classified as a private sector employee you will no longer be entitled to the privileges that of a govt employee and all your efforts of clearing such examinations just to get a govt job will go in vain.

A. Fraud is a crime and hence it will be punishable under the Indian penal Code.
