A. Hi,
If your wife has contested divorce, you have to also present your side, however, you at the same time you can file a custody suit, to get the custody of your children.

A. Hi,
1. The wife can file a case, but your friend can prove his innocence. e can also seek divorce from her on the ground of her being of unsound mind.
2. Your friend and his wife can go in for mediation or conciliation to help them better understand their differences. The wife might be more inclined to go for a mutual consent divorce afterwards.
3. Making false claims is punishable under Section 209 IPC.
4. He can be charged depending on how much his wife knew about the girlfriend.

A. Now this is matter of ego. If you wish to continue this marriage you have to take some action for compromise and go to the police station and request to arrange councelling and mediation as you have registered criminal case.
Else just send a legal notice and file restoration as per sec 9 of HMA.
YOU HAVE AN OTHER OPTION TO FILE DIVORCE CASE IF TJINGS ARE NOT MOVING AS PER YOUR EXPECTATIONS.

With regards to any of the property that your father inherited from his ancestors, you and your mother would be qualified as class I legal heirs and by virtue of law whether your grandfather died without having a will made, you both would get an equal partition in the ancestral estate.

A. Good morning.
My advice is to settle the matter as early as possible by giving reasonable amount to her. And or else if you are willing to cohabitation with her you have to file RCR petition through an advocate in jurisdiction court. Or else take mutual concern divorce it is better remedy for you both to take divorce and continue your life with an other marriage.

1. Restoration of conjugal rights is when the Court orders the parties to resume communication in person. The advantage is that you get to see your wife and convince her a divorce is not necessary.

A. Hi,
The husband has a right to file a petition for divorce with or without mutual consent.
A case for divorce may be filed under section-13(1) of the Hindu Marriage Act, 1955.
