Yes you may file a divorce petition on the ground of cruelty, you can also claim for maintenance. And if you want that children should not live with him, then you can get the custody of children.

Decree of divorce is enough. Marriage once registered can not be cancelled it can only broken by decree of divorce. After the decree of divorce the certificate has no legal identity

A. Hi,
You can file for anticipatory bail to the Sessions or High Court. The limitation period within which to file a dowry case is 7 years, so your wife does not have the law on her side with regard to the Dowry Prohibition Act. As the cruelty case is false, you can make an application the High Court under Section 482 of the Criminal Procedure Code to quash the complaint. This application must be accompanied with whatever evidence you have to show that the case is false.

You can submit them as evidences but, maintenance only depends upon the discretion of the court.

You can immediately get interim maintenance if you file application under Section 125 of Cr.P.C and then try for mediation to settle the issue and you can save the marriage.

Since you are ready to pay decent amount in case of mutual divorce, also, and your wife is demanding more amount which is unreasonable, you may approach the court for the divorce.
