A. Hi,
Divorce cannot be filed within the first year of marriage. You can approach the court for annulment of marriage, as the marriage was not consummated. It would be very hard to prove though.

First, think about your decision, if you want to give her divorce then ask for a mutual divorce. Discuss with her about your kid's future and custody, education, etc., and then decide mutually terms and conditions relating to divorce. If she is only troubling you, then take her for counseling, to understand her behavior is harmful to her kids also.

A. Hi,
She cannot register the second marriage since it would be void as per S.27 of the Special Marriage Act, 1954 when there is already a living spouse. Further she would also attract punishments as u/S 494 and 495 of IPC.

A. You have strong case. Wife is already living seperately for last three years is a good ground for divorce on the ground of cruelty and desertion. In such circumstances DV case is s not maintainable. In dowry case you have good defence. Court also know that women take undue advantage by misusing the law.
