Hi, I am 29 yrs old married lady and completed 2 yrs of marriage in feb this yr. Currently i am residing with my parents from last 4 months due to some dispute with husband. Also i am 5 months pregnant with my first child.Since i have got pregnant,my husband and in laws have become ignorant towards me and stopped talking to me completely and also my husband threatned and mentally harassed me to file a divorce as i have left my in laws. But i am not ready to give divorce as i will have the responsibility of the child and also i am unemployed.Please tell me what actions my husband can take against me and what what should i do if i get any such notice from his side?

A.1. if you want to remain in the #matrimonial relationship, then, try to settle the matter amicably with your husband involving elders/relatives/friends etc and start afresh,
and
if, failed, file #Restitution of conjugal rights petition in the Court,

2. your husband can file a case of RCR or Divorce against you,
--if he files the RCR, you can file the

#Domestic Violence case agaisnt your husband (for causing #mental, emotional, physical and monetary abuse, etc)
you have rights to claim #residence, #protection, compensation, maintenance,
**also file an application for interim maintenance under section 24 of HMA to claim the maintenance during pendency of the trial,

--if he files the Divorce, you can file the

#Domestic Violence case and RCR against your husband

**also file an application for interim maintenance under section 24 of HMA to claim the maintenance during pendency of the trial (Divorce case)

A.Hi,
First, your husband can send you a legal notice seeking a divorce. Second, he can also file a suit for divorce under S.13 of the Hindu Marriage Act. You can reply to his legal notice wherein you can state your reasons and also mention the dispute.

A.Hi,
The actions available to your husband are first, issuing you a legal notice and second, filing for divorce u/S 13 of the HMA before the family court. If you get any legal notice from his side, you can file reply where you can state your reasons for leaving your in-laws and your dispute with husband.

A.अभी शादी को आपकी कम समय हुआ है।जो झगड़ा आपके बीच है उसको बेठ्कर सुलझा ले ।आपका पति आपकी मर्जी के बिना कोई तलाक नही ले सकता है।
शादी का टूटना एक बहुत बड़ा सामाजिक कलंक हैं।अपना घर बसाये ओर आने वाले बच्चे का पालन पोसन दोनो मिलकर करे।

A.you dont need divorce then why you were living with your parents.
you dont want divorce only because of child future and you are unemployed ? If that is only reason then you can take divorce with maintenance and separate residence from your husband.

if you dont want divorce for other reasons then go back to house and see how to proceed.

A.Try to reconcile the matter amicably through relatives and common friend. Living seperate deepen the differences. Unless you agree your husband cannot be able to take divorce. Woman are more empowered in law. You are entitled to maintenance and also have right to live in your matrimonial house and neither husband nor his parents can stop you.

A.Dear Madam,
As per given statement , if ur husband will serve you legal notice , then amicably reply with all his misbehaving and your interest to resolve issue, or if he files divorce at court, then you defend case as per his petition and your points and situations.
In my opinion, you should try to convince and restore your conjugal life. Onece you are in court, you may face financial difficulties and for maintenance, the court will take time after filing petition from your side.
