A. Dear Sir,
Normally, both the parties or advocates their respective advocates must be present. It being a ex-parte so the Magistrate has to give a chance to the other side before or after hearing the Respondent.

There are multiple ways to about with this issue. The mother and the sister both can be protected under the PWDVA, 2005. They can approach the police station and file a FIR/DIR. The police station will guide them to the Protection Officer of the region. They can also contact the Protection Officer directly. National or State Commission for Women or other NGOs and Helplines can be contacted.

I am sorry to hear for what you have gone through. You always have an option for consulting another advocate or changing your advocate. In your case a lot of papers are to be reviewed. Suggesting, anything without studying and reviewing your record does not deem fit.
There might be or might not be a necessity for such delay in the filing counter. Contact an advocate who specializes in divorce matters, immediately.

A. Dear Madam,
Even in worst case husband who is hale and healthy is suppose to pay maintenance to the wife. A son is not suppose to get any share in the self acquired properties of his parents. You may file maintenance case both under the provisions of Domestic Violence Act and under Section 125 of Cr.P.C.
