The Special Marriage Act, 1954, does not allow solemnisation by proxy or PoA. The physical presence of both parties is mandatory at
the time of marriage for the following reasons:
Section 12 of the Act requires both parties to sign the declaration in presence of the Marriage Officer and three witnesses.
The Marriage Certificate Book is signed in person.
There is no provision for virtual or proxy marriage under this Act.
