Passport Renewal

I have applied for passport renewal under tatkal scheme through agent. But while filling online form, my agent haven't disclosed regarding my pending case which is under trial. Now I have received my passport but in police verification they wrote about my pending case and I received a letter from RPO to surrender my passport. What to do further as my case is pending from last 11 years and it may take another 10 years to decide.
