If it was given to your grandfather, and he did not specify to whom the property would belong in his will, then your aunt has a claim over the property as she is also your grandfather's legal heir. You can file a suit for declaration of title if you believe you have a better right and have invested more in the property.

If it is a joint loan, you will need your brother's consent for the same. After this, he can file for transfer of property or a suit for declaration of title to appoint you the sole owner of the property. You will need originals of all the documents, xerox copies will not suffice.
