According to the Hindu Succession (Amendment) Act, 2005, your daughter has a legal right over her father’s ancestral property. She can claim the property any time during her father’s lifetime or even after his death. If father dies intestate, the children of legitimate marriage(i.e., first marriage will have share in the self acquired as well as ancestral share of properties held by the father before his death or left behind him after his death.

The execution of a Will is to be done by the executor appointed for the purpose by the testator. It is nothing but the distribution of property of the deceased according his/her intent as worded in the Will. In order to start his duties as an executor of a Will, a probate is necessary. For this to be realized, the executor should apply for probate of the Will before a competent Court.
