I made a payment as advance for a land deal in the name of the owner of land through an agent .I had requested the agent that I will verify the land details then only the cheque should be presented to bank for clearance. But he gave the cheque to the owner and he got it cleared the same day.After verifying I found that the land was not suitable for me and I asked the age3to get my money refunded.He assured me that you will get ot within 2 weeks.Now it is almost 3 months and these 2 weeks have not come. I am reminding him almost daily but till date he has not done anything for refund of money.I have got some WhatsApp conversations and phone recordings with me which are related to money transaction What should I do now?Please note Agent is a relative also...

A.1) You have been a victim of bad investment through the agent.
2) What kind of land have you given the advance ?
3) When had you made the payment to the owner of the land?
4) Who is the person who got you to the Agent are you knowing the agent from a very long time?
5) If the land details are NOT verified how could the agent give the cheque to the LAND OWNER for the clearance. Now tell the agent to give his own cheque in a very friendly manner for the return of the money and tell him to take to return from the b land owner as you had clear-cut told in to put the cheque for clearing only when you would find out the details of the land.
6) So by default the agent is a very mischievous person who has put the cheque to your bank for clearing without any further information from your end. Thus getting this money back is a really big headache for you now. But you have to use some tactics to get the refund cheque though if it is a PDC will also be a no problem but, then and you will at least have some kind of proof for the return of the investments

A.Try amicable solution for your money recovery. If other side requests some more time for paying back just ask for cheque to be drawn in your name on that suitable date. This would also clear intention of the party whether really going to pay back you or only dilly dallying. If that doesn't work you would have to file appropriate proceedings. Thanks n regards

A.You have to file a civil suit to get your money, there is enough ground to file the civil suit we need a face to face conversation for filing the civil suit you have to come come to the my chamber with all the telephonic conversation and text messages.

A.You will have to recover the money from the owner of the land not from the agent. Keep watch on the address and contact details of the owner of the land so that you can trace him to proceed against him. First give the land owner a legal notice asking for the refund. He will be entitled to withheld the "bayana" amount (if agreement to sell has been made). If he doesn't pay heed to the notice then you can file a case for the recovery of the money. If you have entered in the "agreement to sell" then you have to file a case for the cancellation of the contract. You should have valid reason for the cancellation of the contract.
