Description
Mr. X had some landed property. The OLR case had been finalised and distributed the total land into his three sons like S1, S2, S3 and himself, total four share. and accordingly four mutation case was initiated and finalised. Mr.X had a share of land exclusively owned by himself and out of which he had sold a piece of land to S2. And during his life time S1 family had been taken care of Mr. X and other two son S2 & S3 never asked even for a cup of tea. To meet his necessity Mr.X has sold some land to P1 & P2 with two registered documents. Mr. X had made a registered willnama to give some land to his eldest grandson GS1 who was taken care to him. Further Mr.X had transferred the said land to his grand son GS1 and the portion of homestead land to S1. Meanwhile the GS1 has mutated the said land but as the Tahasil authority couldnot submit the said document to the settlement department the same land is included with original khata of Mr.X. On the otherhand the land purchased by S2 is also included in the original khata of Mr.X. But S2 could able to manage the Tahasil authority during the Hal settlement and transfered his land to his name. GS1 has the registered documents with Sabik Khata and Plot numbers. After the Settlement 2013 new Patta came out and the land of GS1 included with the khata of Mr.X. The land purchased bu P1 & P2 are also included with the khata of Mr.X. Now after the death of Mr.X the S2 & S3 claims another share from the entire lands of Mr.X including land purchased by GS1 and P1& P2. After getting a share from the father in the OLR final case whether the said sons S2 & S3 have right to get share or not. What is the future of the registered documents of GS1 and P1 & P2...? Further the S2 has got mutated some land of Mr.B by showing himself as the son of Mr.B and the S3 has shown himself as major and married during the OLR case by showing his wife though he was a minor and not married. Now the S2 & S3 trying to grab the entire land of Mr.X ignoring the registered documents of Mr.X. So please advice that how GS1 and P1& P2 will get justice.
