Hello Sir/Madam,
I have taken handloan of 5 lakhs from a friend. And I returned the same amount to her as promised. But, due to lockdown, I could not return 40,000 which I promised as interest to her. I asked for two months of time. But, she is not agreeing on that and she is pressurizing me daily for money.
Does she have right to force me for extra money.?
She is not a registered financier. And interest rate is 10%.
She does not pay tax for this extra amount.
Please suggest me what can I reply to her.

A.You can file criminal case against her.

Dear Sir,
Get issue a legal notice through lawyer and wait for his response and if he ignores the legal notice you send him the notice second time.
After second time also if he ignores you can file a suit in the civil court which comes under your jurisdiction.

Taking all the documentary evidence available at your end and also you can claim for damages for cheating you and causing pain and litigation fees too.

1. Two legal notices and their acknowledgements
2. Promissory note between the parties
Suit value of 3 lakhs the court fee payment is 5426/-in A.P and Telangana and more than
three lakhs if you want to claim for every ten thousand hundred rupees of court fees to be paid.
Hopefully once you send the legal notice the party would approach you for a settlement.

A.I have gone through your query in detail.
1) You are a Victim of Private Financier. You are paying Rs.40k / 10% Monthly for 5 lakhs is exorbitant charges. You seem to be a educated person then too you have taken a loan @10% monthly is quiet surprising.
2) Due to the lockdown situation even the financial institutions such as banks and NBFC have relax the norms for repayment of the loans and other installments. This lady is pressurizing you for money make sure that you record all her calls and SMS.
3) Send a legal notice n file a case against her for her exorbitant charges of 10% interest rate.
4) Also you have not mention is she taking 10% on monthly basis or yearly basis. It is high time that you should take a legal action against such kind of private financiers without registration, n take them to the court for further law and order so at least other common people may benefit from such kind of unofficial financiers.
