I have done a partnership agreement with my partner and have notarized it on Rs 500 stamp paper but didn't get it register. Now my partnership is about to over amd he have to pay me 70% of total money i invested in the construction on his land. It was mentioned in the Stamp paper but he is refusing to pay. I want to know can i sue him and win the case? Or it's weak because i didn't register the partnership deed.

A.Firstly it was not a partnership firm as the firm was not registered hence any proceeding is barred against so called partnership firm due to prohibition provided under section 69 of partnership Act. Notarised agreement has no legal validity except that an agreement was executed. So you can file suit for recover against other party claiming your share.

A.Yes, you cannot sue as it is not registered. But in your individual capacity you sue and settle matter in police station by managing the police and close the partnership business.

A.Yes you can approach court. Or file money recovery suit

A.As you have done a partnership agreement with my partner and have notarized it on Rs 500 stamp paper it is Valid. But what are the internal terms & conditions. Have you maintained all the records. Have you made the investment on materials by Cheque Payment & do you have the receipts & proof. As he is refusing to pay send him a legal Notice for the pending dues & sue him in court. (Always remember just registration of Partnership does lead to winning of any case but, it depends on the evidence & proof generally accepted by court)

How unregistered agreement form or validate a partnership? What about prohibition provided under section 69 partnership Act? Pl. Consult law before giving any opinion. Pl donot give wrong informations to innocent people.
