Hello Respected Legal Advisors: My question is as below. Thanks in advance for the person/persons answering. I have my tenant who is occupying my property for the past 33 years. As per unregistered lease agreement, he has 9 more years remaining of the lease period where he can stay in my premises. His rentals accumulate to a pittance of Rs. 2000 p.m. wherein today's market rate is around 2.5 lakh p.m. for the same premises. The said tenant is demanding Rs. 2 crore for evicting my premises. After failing to evict him legally, wherein the case was dismissed with the judgment stating that he can remain in my premises for the remaining period of the least period as per agreement. My query would be, I am getting the rental of Rs. 2000 by cheque delivered to my door step every month. I am in the process of shifting my house, in which case I will not be able to get the rental cheques delivered. Can I use this pretext to file a new case of non-payment of rent to evict the tenant after waiting for 6 months or so? Will this work in my favor? Kindly advise. Thanks again in advance.

A.You will need to file eviction suit immediately against them.
