The rent agreement for 11 months revised from 1st November and the tenant requested not to change the deposit which was about 6K less but we agreed. The tenant said he'd pay on 10th we agreed but he never paid even on 10th always 2-3 days late after reminders which was ok. In staring March first he said he won't pay but then he agreed. In April he gave Corona reason and asked to adjust one month's rent with security deposit. It was a problem for us as we had to pay school fees and EMI but still, we agreed. In May he paid 8K less. In June he paid only one month rent without pending amount that also on 21st. In July he declared that he'll not pay advance and will pay only on the last day of the month and after reminders and WhatsApp messages paid on 31st. Till now he hasn't paid and doesn't know how it'd go. The agreement is ending on 30th September. By the time 30th Sep comes, I'll not be having even one month's security now. Please advise what is the procedure for eviction. In the agreement its written as 30 days notice.

A.Dear Sir
You may get issue a statutory legal notice under section106 of transfer of property act then file simple eviction suit. In the court he has to deposit arrears of rent without which he is not allowed to contest the case .
