Sir/Ma'm I stay in a slum in kandiwali Mumbai. Adjacent to my house is an electroplating unit which emits toxic fumes( Hexavalent chromium, highly carcinogenic). The unit is operating illegally since 2008 and till 2019 they didnt even had a chimney. The fume is a grave health hazard to my family as it enters our home. Repeated pleas to the owner and municiple authorities have went unheeded hence I think the only way to resolve this is through courts. My mom was diagnosed with cancer in 2014 and I think these fumes were the only cause for it. We have spent close to 8Lakh rupees on her treatment. Now I want to sue the owner for damages. Can I legally do it? The owner is indirectly exploiting us and forcing to breathe in the very toxic air. We cannot shift elsewhere due to dire financial situation. Kindly help.
