What to do if Vehicle seller refuses to give NOC from Bank and refuses refund

Hi Sir,
I had purchased a bike last year. Paid 55000 and 17000 payment is remaining. The deal was that the seller would give me NoC from bank in a month(Have this in writing from the seller). I was not aware that he has not paid the dues. Now it has been more than a year and he is not giving NOC from the bank and I cannot transfer the bike to my name. I requested him multiple times to take the vehicle back and return the money but he is refusing to do so. He even said file an FIR if you have to. Now I am stuck with 55000 hole in my pocket with a bike I can't use. Kindly help.
